What kind of business entity should I form?
There are several types of business entities, whether you choose an LLC, a Corporation, a Partnership, or a Sole Proprietorship to name a few. Each has its own advantages and disadvantages. Your attorney and accountant will look at your business and propose the best business type for you.
Choosing a Name.
If you are starting a business that will be doing business on a national scale, the very beginning is the best time to consider how your name will be used. You can do a national check on registered names and trademarks, to assure that you are nt confronted with the legal issues coming from competition with other entities of the same or similiar name.. You can also check your local state corporations office and check name availability. Many states are now on the internet and you see if your business name is available. Who runs my company?
Before consulting with your attorney to begin the process, think first about who will share ownership of the company and what roles each person will be responsible to handle. When is comes time to establish a business identity, the duties of each Director, Officer, Partner or Member will need to be clearly established.
